BY CONTINUING YOUR USE OF THIS WEBSITE, YOU ACKNOWLEDGE THAT YOU AND/OR THE ENTITY YOU REPRESENT (THE ‘CUSTOMER’) IS HEREBY AGREEING WITH FRECKLED SOULS TO THE FOLLOWING TERMS AND CONDITIONS AND ANY TERMS INCORPORATED HEREIN BY SPECIFIC REFERENCE (COLLECTIVELY, REFERRED TO AS THE ‘TERMS’).
1. Definitions
‘Confidential Information’ means any information disclosed by one party to another which is defined as confidential and proprietary as per this Terms and Conditions Agreement;
‘Customer’, ‘Subscriber’, ‘End-user’ and/or ‘You’ means any natural person or a single entity, corporate or other statutory body with legal personality that is subscribing to the services provided by Freckled Souls;
‘Device’ or ‘Devices’ means computer hardware, network, storage, input/output or electronic control devices, or software installed on such devices;
‘Intellectual Property Rights’ means all intellectual property rights including patents, trademarks, design rights, copyrights, database rights, trade secrets and all rights of an equivalent nature anywhere in the world;
‘Service’ means the Service offered by Freckled Souls which comprises of information on the services offered by Gestalt psychotherapist Marija Schranz (PPBM warrant number 345).
‘Terms and Conditions’, ‘Terms’ or ‘T&Cs’ mean the terms as per this Terms and Conditions Agreement;
‘URL’ or ‘URLs’ means the address of a web site;
2. Scope
2.1 The scope of this website is purely to provide information on the services offered by Gestalt psychotherapist Marija Schranz (PPBM warrant number 345). For this reason, the use of the website is possible throughout without the need to input any personal data.
2.2 Further information/clarification may be sought by emailing contact@freckledsouls.com.
2.2.1 For all intents and purposes, it is hereby being clarified that any and all services provided by Gestalt psychotherapist Marija Schranz shall not be covered by these T&Cs and you shall be provided with a separate agreement in the event that you engage Ms Schranz for her services.
2.3 By visiting this site you agree to be bound by these T&Cs, including those additional T&Cs and policies referenced herein and/or available by hyperlink, such as the Privacy Policy (which also contains information on cookie usage). Please read them carefully before further using this website.
3. Liability for content
3.1 The contents of this website were put together exercising due diligence and attention. However, this is not a guarantee as to the correctness, accuracy, completeness, and actuality of the contents. The website may also have information that is not up to date.

4. Copyright and Intellectual Property Rights
4.1 The content on this website, including the name Freckled Souls and the logo, is subject to copyright law and cannot be copied, processed, or distributed further, unless previous written consent is sought from the author who may be contacted as per the details found on the Contact page.
4.2 All Intellectual Property Rights in Freckled Souls, and in all additions, corrections, and improvements thereto, produced by Freckled Souls and provided to the User shall at all times remain the property of Freckled Souls. This shall also apply to intellectual property rights in all work done by Freckled Souls for the User.
4.3 The website is protected by copyright and all other applicable intellectual property laws, particularly by the Copyright Act, Chapter 415 of the Laws of Malta and the Intellectual Property Rights Act, Chapter 414 of the Laws of Malta, as well as by international conventions, agreements and treaties, unless specifically excluded herein.
4.4 This Terms and Conditions Agreement does not convey to the User an interest in or to the website, but only a limited right of use revocable in accordance with the Terms of this Service Agreement. No license or other right to the Website is being granted to the User except for the rights specifically set forth in this Terms and Conditions Agreement.
4.5 The User hereby agrees to abide by all applicable laws and international treaties, and undertakes to inform Freckled Souls of any suspected breach of Intellectual Property Rights belonging to Freckled Souls.
5. Amendments to Terms and Conditions
5.1 If any of these Terms and Conditions are determined to be illegal, invalid, or otherwise unenforceable by reason of the laws of any state or country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid, or unenforceable, it shall be severed and deleted from these Terms and Conditions and the remaining Terms and Conditions shall survive, remain in full force and effect, and continue to be binding and enforceable.
5.2 These Terms and Conditions may be revised from time to time. The revised Terms and Conditions shall apply to the use of the website from the date of publication of said revision on the website and you hereby waive any right you may otherwise have to be notified of revisions of these Terms and Conditions.
5.2.1 Provided that your continued use of the Website following revisions of these Terms and Conditions shall be deemed as an acceptance of such terms and conditions from your end.
6. Contracts relating to Psychotherapy Services
6.1 Nothing on this website nor in these T&Cs may be taken to supersede the contract of service that clients of the psychotherapy service conclude as part of their therapeutic agreement with gestalt psychotherapist Marija Schranz (PPBM warrant number 345) at onboarding stage.
7. Applicable Jurisdiction
7.1 This agreement is governed by Maltese law. In the case of a dispute, the parties agree to submit to the exclusive jurisdiction of the Maltese courts.
